Hit While Cycling: Your Rights After a California Bicycle Accident

California’s sunny weather makes it one of the best places in the country to ride a bike – and one of the most dangerous. Cyclists share the road with fast-moving traffic and little protection, and when a driver is careless, the results can be devastating. If you have been hit while cycling, it is important to know that the law is often on your side.

Here is what every California cyclist should understand about their rights.

Cyclists Have the Same Rights as Drivers

Under California law, bicyclists generally have the same rights and responsibilities as drivers of vehicles. That means a cyclist injured by a negligent motorist has the same right to pursue compensation as any other accident victim – for medical bills, lost income, and pain and suffering. Drivers are required to share the road, and when they fail to, they can be held responsible.

Common Causes of Bicycle Crashes

Many bike crashes follow familiar patterns, most of them caused by driver carelessness:

  • Unsafe passing – California’s “Three Feet for Safety” law requires drivers to give at least three feet when passing a cyclist.
  • “Dooring” – an occupant opening a car door into a cyclist’s path.
  • Right and left “hooks” – a driver turning across a cyclist’s path.
  • Distracted or impaired driving, and failing to yield at intersections.

What About the Cyclist’s Fault?

Insurers often try to blame the rider. But California follows a “comparative negligence” rule, which means that even if you were partly at fault, you can still recover compensation – your award is simply reduced by your share of responsibility. And it is worth knowing that not wearing a helmet does not bar an adult cyclist from recovering, though it can become part of the discussion.

If You’ve Been Hit

After a bicycle crash, get medical care right away – head and internal injuries are not always obvious – and make sure the police create a report. Photograph the scene, your bike, and your injuries, get witness information, and preserve your damaged gear. Then get legal advice before speaking with the driver’s insurer.

A cyclist hit by a careless driver deserves to be taken seriously – not blamed. If you were injured in a bicycle accident in California, Ellin Mardirosian Law offers a free consultation to explain your rights and pursue fair compensation.
